To use certain features of Foilcase you must create an account. You agree to provide accurate and complete information when creating your account and to keep your account information up to date. Accounts are created and managed through Clerk, our authentication provider.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@foilcase.com of any unauthorized use of your account.
Your username must be appropriate and not infringe on the rights of others. We reserve the right to reclaim or reassign usernames that violate these terms or that have been inactive for an extended period.
You may request deletion of your account at any time by contacting us at hello@foilcase.com. We reserve the right to suspend or terminate accounts that violate these terms.
You retain ownership of any content you submit to Foilcase, including card data, images, and profile information. By submitting content, you grant Foilcase a non-exclusive, worldwide, royalty-free license to use, display, and store your content solely for the purpose of operating and improving the service.

You may upload images of trading cards you personally own. You are responsible for ensuring you have the right to upload and display any images you submit. Foilcase stores card images in a secure cloud storage environment provided by Supabase.
If you choose to make your vault public, your collection data will be visible to all users and visitors of Foilcase. You are solely responsible for the content you choose to make public. You can make your vault private at any time in your account Settings.

Foilcase integrates with third party services to provide its features. Your use of Foilcase is also subject to the terms of these services:
We are not responsible for the content, privacy policies, or practices of any third party services.
Foilcase participates in affiliate programs including the Amazon Associates Program and the eBay Partner Network. This means we may earn a commission when you click on certain links and make a purchase, at no additional cost to you. Affiliate links are clearly identified on our platform. We only recommend products we believe are genuinely useful to collectors.
The Foilcase name, logo, and all related content, features, and functionality are owned by Foilcase and are protected by copyright, trademark, and other intellectual property laws. You may not use our branding, logos, or trademarks without our prior written consent.
Card images, player names, team names, and related marks are the property of their respective owners. Foilcase does not claim ownership of any third party intellectual property displayed on our platform.
Your use of Foilcase is subject to our Privacy Policy and Cookie Policy, which are incorporated into these Terms of Service by reference. By using Foilcase, you consent to the collection and use of your information as described in those policies.
Foilcase is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:
Card values displayed on Foilcase are estimates based on eBay market data and should not be relied upon for insurance, financial, or investment decisions. Always consult a professional appraiser for formal valuations.
To the maximum extent permitted by applicable law, Foilcase's total liability to you for any claims arising out of or relating to these terms or your use of the service shall be limited to the amount you have paid to Foilcase in the twelve months preceding the claim. For free tier users, this amount is zero.
In no event shall Foilcase be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of collection value, or loss of goodwill, even if advised of the possibility of such damages.
Before filing any formal dispute, you agree to first contact us at hello@foilcase.com and attempt to resolve the dispute informally. We will make good faith efforts to resolve the issue within 30 days of receiving your notice.
If informal negotiations fail to resolve the dispute within 30 days, both parties agree to resolve the dispute through binding individual arbitration rather than in court. This means you waive your right to a jury trial and to participate in a class action lawsuit. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) in the English language.
Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm while arbitration is pending. Claims related to intellectual property infringement are also excluded from mandatory arbitration.
These terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Texas.
We reserve the right to modify these terms at any time. We will notify users of significant changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of Foilcase after any changes constitutes your acceptance of the new terms. We encourage you to review these terms periodically.
If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
